From 1 January 2017, the process for review under the Military Rehabilitation and Compensation Act 2004 (MRCA) will change:
- The legislation has been refined to provide a single appeal pathway to the Veterans’ Review Board (VRB).
- This will remove the ability of a MRCA claimant to seek Commission (MRCC) reconsideration of an original determination. The Commission will reconsider original determinations on its own initiative.
- DVA will screen all requests for review upon receipt and will notify claimants once this has occurred. Should the decision remain unchanged, the appeal will proceed to the VRB.
- The Administrative Appeals Tribunal (AAT) may award costs in certain circumstances in relation to matters which have been appealed from the VRB.
