Veterans' Entitlements Amendment Act 2018

The Veterans’ Entitlements Amendment Act 2018 (the Act) received Royal Assent on 25 September 2018 and commenced on 26 September 2018.

The Act amends the Veterans’ Entitlements Act 1986 (VEA) to allow the Department of Veterans’ Affairs to reduce the bereavement payments where an overpayment of a service pension occurred.

The amendments do not change current entitlements of surviving partners to Bereavement payments.

The Act provides legislative certainty for past and future recoveries of pension overpayments from bereavement payments, and will maintain the current discreet practice to respect veterans’ families mourning their loss.
